Also, Bharat Fresh Market may provide links to the sites of affiliated companies and certain other businesses whose products and services are not assured by Bharat Fresh Market. We are not responsible for the offerings of, any of these businesses or individuals or the content of their website.

Pricing

All the products listed on the Application will be sold to our customers at MRP unless otherwise specified. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. In case the prices are higher or lower on the date of delivery no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

Credit / Debit Card Use

During a card transaction, you must use your own debit or credit card for payment. Bharat Fresh Market is not liable for any credit or debit card fraud. The liability to use a card fraudulently will be on the user of the website and the onus “if proven otherwise” will be exclusively on the user. You further agree to provide the correct and valid credit card details to Bharat Fresh Market.

We reserve the right to cancel any or all orders placed using credit cards which is registered under an International billing address.

Cancellation by Site / Customer

As a customer, you can cancel your order anytime up to the cut-off time of the slot for which you have placed an order by calling our customer service. In such a case, we will refund any payments already made by you for the order. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

Delivery/Shipment of Product

Delivery of the Products under your Order in the Website and application shall be made as per our Delivery/shipment policy mentioned herein. Title of the Product shall pass on to you upon receipt of payment.

Order Tracking

Once the order has been dispatched from our delivery point, an email or an SMS will be sent to you on the email address and mobile number provided by you under "Billing Address" and Order placed with us. You can track your order online by the ID Tracking number sent to you by us on your Mobile/Email ID.

You may also log on to your account on the application or use the "Track my Order" link on the website and application to track your order.

Governing Law and Jurisdiction  

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Kolkata shall have exclusive jurisdiction in any proceedings arising out of this agreement. The High Court of judicature at Kolkata alone shall have the jurisdiction and the Laws of India shall apply in case of any dispute arising out of these terms and conditions, user agreement, privacy policy or the documents they incorporate by reference and/or your use of the Website and application shall be governed and construed in accordance with the laws of India, notwithstanding any conflicts of law.
